Practice Overview

Our firm represents small and large companies in navigating the complexities of California’s unique toxic labeling law, Proposition 65.  Peg Carew Toledo has over 14 years of experience in Proposition 65 matters.  Over the years, she has provided Fortune 100 companies with Proposition 65 compliance advice, regulatory advocacy, and litigation defense. 

 

Peg has litigated Proposition 65 cases against the California Attorney General as well as private prosecutors.  In addition to Proposition 65 litigation, Peg has counseled large and small companies regarding a variety of Proposition 65 compliance issues.  Peg also has worked with companies to develop Proposition 65 compliance programs and perform compliance audits of existing products.

 

Peg’s clients include manufacturers, distributors, and retailers of foods, beverages, dietary supplements, cosmetics, clothing, fashion accessories, and household products. 

 

Peg is a member of the Prop. 65 Clearinghouse Advisory Board.  She regularly speaks on Proposition 65 issues and hosts an annual Proposition 65 compliance seminar. 

 

Proposition 65 Representative Matters
  • Currently representing several dietary supplement companies with respect to Proposition 65 notices of violation issued by Environmental Research Center involving allegations of lead in dietary supplements.
  • Currently representing three dietary supplement manufacturers in litigation brought by the California Attorney General involving allegations of lead in dietary supplements.
  • Represented a national retailer concerning allegations of lead in kitchen utensils, water bottles, paper clips, and safety pins.
  • Represented major food manufacturer in regulatory proceedings and litigation brought by the California Attorney General involving acrylamide in potato chips.  
  • Defended global pharmaceutical company in an action brought by the California Attorney General involving two mercury compounds, thimerosaland phenylmercuric acetate, in nasal sprays.
  • Represented children’s clothing manufacturer regarding allegations of lead and DEHP in children’s apparel.
  • Defended major cosmetic manufacturer in an action involving alleged exposure to toluene in nail polish.
  • Represented one of the largest global consumer product companies in Proposition 65 litigation concerning allegations of Proposition 65 listed chemicals in cosmetics, shampoo, laundry detergent, toothpaste, body lotion, bleach, and over-the-counter pharmaceuticals.
  • Negotiated a favorable settlement for large beverage company in an action brought by the California Attorney General involving alleged exposure to lead from the applied ceramic labels on glass soft drink bottles.
  • Negotiated a favorable settlement for computer manufacturer in an action involving alleged exposure to lead from computer motherboards.
  • Defended dietary supplement manufacturer in litigation involving alleged exposure to progesterone from wild yam cream.
  • Advised several dietary supplement manufacturers and distributors concerning compliance with Proposition 65.
