As counsel to some of the largest brokerage firms in the country, Eric Glassman has extensive experience in litigating customer disputes throughout the West in federal and state courts and before arbitration forums. In the past 15 years, Eric has successfully handled hundreds of such disputes, in many cases securing a complete dismissal of all claims. Eric focuses on developing litigation strategies that meet the particular needs of each of his clients. “Being a zealous advocate of a client’s interest requires active listening.” Eric works with clients in investigating the facts behind a claim and in exploring the goals the client would like to achieve in its resolution. “My clients’ needs are diverse. Even with cases that appear to present similar facts and legal issues, my clients’ interests often are best served by using very different approaches toward a resolution.”
Having grown up amidst a family-owned business, “I learned early on that legal costs are a line item; that the best lawyers are ones that understand your business and work to further its goals in a practical manner. Litigation is rarely an end in and of itself. There is an employee’s reputation to protect, a company policy to defend, or a business relationship that must be maintained. Only by working with a client from the outset can these various factors be incorporated into a sound litigation strategy.”
Eric began his career with Orrick Herrington & Sutcliffe in Sacramento, working in its litigation group. In 1997, Eric left Orrick to establish Mennemeier, Glassman & Stroud.
Upon graduation from law school, Eric clerked for the Honorable Oliver W. Wanger, federal district judge for the Eastern District of California in Fresno. While clerking, Eric worked on a number of cases involving natural resources and agricultural law. Eric graduated magna cum laude from the Georgetown University Law Center in 1992. He also holds a Masters Degree in Education and a Bachelor of Science in Political Science from UCLA.
- Kingswood v. Button, represented institutional client in state court action on claims of fraud and conversion brought on behalf of large number of investors on behalf of more than 80 individuals as to a private placement investment.
- Haley v. MLCC, represented mortgage lender on state court allegations of deceptive collection practices.
- Ryan, et al. v. Shearson Lehman Hutton Holding Inc., represented brokerage firm in litigation brought by pool of investors alleging misrepresentation in sale and marketing of limited partnerships.
- Yamasaki Farms v. Lipton, successfully defended cannery in private arbitration against claims that cannery breached contract by refusing to accept shipments of tomatoes sprayed with pesticides.
- Betchart v. Stifel, Nicolaus & Co., represented brokerage firm in NASD arbitration on claims of misrepresentation as to sale of securities.
- Telahun v. Merrill Lynch, Pierce, Fenner & Smith, successfully defended brokerage house and individual respondents in NASD arbitration hearing against allegations related to options trading and failure to hedge concentrated stock position. Later, successfully represented brokerage house in state court action to confirm dismissal of claim.
- Don v. Merrill Lynch, Pierce, Fenner & Smith, successfully defended brokerage house and individual respondents in NASD arbitration against claim that customer was wrongfully blocked from accessing joint account during divorce proceeding.
- Worden v. Merrill Lynch, Pierce, Fenner & Smith, successfully defended brokerage house and individual respondent in NASD arbitration against claim that broker made unsuitable recommendations to an elderly client regarding purchase of mutual funds.
- South Bay Urology v. Merrill Lynch, Pierce, Fenner & Smith, successfully defended brokerage house in NASD arbitration against claims of unsuitable investments in professional’s retirement and pension plan accounts.
- Bierce v. Merrill Lynch, Pierce, Fenner & Smith, represented brokerage house and individual respondent in NASD arbitration against allegation of elder abuse in connection with purchase of variable annuities.
